Melbourne Magistrates' Court

Melbourne Magistrates' Court is the principal registry and headquarters of the Magistrates' Court of Victoria, located in the city's legal precinct on William Street. It is the largest and busiest court of its kind in the state, open on weekdays.

Sitting at the centre of Victoria's summary justice system, the court hears criminal prosecutions, driving matters, intervention order applications, and civil disputes, and runs a number of specialist lists, including a Drug Court, a Koori Court, and the Assessment and Referral Court for people with complex mental health conditions.

Because the Melbourne Custody Centre sits beneath the building, many people held after arrest first appear here, and the Bail and Remand Court operates from the complex extended hours, seven days a week.

What matters are heard here

The court carries an enormous daily list, most of it summary work or the early stages of more serious prosecutions. The matters dealt with here include:

  • Driving and drink driving charges
  • Summary criminal offences
  • Family violence and personal safety intervention order applications
  • Bail applications, including matters heard in the Bail and Remand Court
  • Committal hearings for indictable charges
  • Civil disputes up to $100,000

Indictable charges that are too serious to be finalised summarily are committed from Melbourne to the County Court or the Supreme Court of Victoria for trial or sentence.
