Best when speed matters and risk is low
Digital evidence (device forensics, metadata, account logs, IP address records) must be independently reviewed by a technical expert. Police forensic analysis is not infallible; we engage qualified digital forensic consultants to scrutinise every exhibit.
Best when facts are complex or disputed
Many online offence cases turn on questions of identity (who actually used the device or account) and knowledge (were you aware of the relevant material). We examine the evidence chain and challenge assumptions made during the investigation.
Best when outcome must be robustly defended
The difference between a State charge and a Commonwealth charge is significant. Commonwealth charges carry harsher penalties and mandatory registration requirements. We scrutinise the charging decision and, where appropriate, seek to have charges resolved under the most appropriate legislative framework.
Online offence investigations may begin with a device seizure, a search warrant, or a police interview request. Do not consent to searches or interviews without first speaking to Sam.
After charges are laid, Sam reviews the prosecution brief including all digital forensic evidence, device examination reports, and communication records. Independent technical experts are engaged where required.
Technical expert evidence is prepared to challenge the prosecution forensic analysis. Sam negotiates with the prosecution on charge level, jurisdiction, and potential resolutions.
The matter is resolved in the appropriate court: the Magistrates Court for summary matters, the County Court for indictable matters, or the Federal Court for some Commonwealth charges.

Generally, police require a warrant to search and seize electronic devices in Victoria. There are limited exceptions (such as if you are being lawfully arrested). Do not consent to an unlawful search.
If police have seized devices without a warrant, that material may be challengeable as unlawfully obtained evidence. Sam will assess the circumstances of the seizure and advise on whether an exclusion application is viable.
