Broadmeadows Magistrates' Court hears both Family Violence Intervention Order (FVIO) applications under the Family Violence Protection Act 2008 (Vic) and Personal Safety Intervention Order (PSIO) applications under the Personal Safety Intervention Orders Act 2010 (Vic).
FVIOs apply between family members, including current and former partners. PSIOs apply between non-family members including neighbours, colleagues or acquaintances. The legal test and available orders are different under each Act.
Do not breach the interim order, even if you disagree with it. Breaching an IVO is a criminal offence. Contact Sam immediately to understand the conditions and your options at the next court date.
An interim IVO is made without you being present. The conditions take effect immediately. The next court date gives you the opportunity to contest the application, consent without admission, or seek undertakings. Sam will advise on the best approach for your circumstances.
Yes. An IVO is a civil protective order. Having an IVO made against you, including by consent, does not result in a criminal conviction. However, breaching an IVO is a criminal offence that can result in a conviction and imprisonment.
An IVO can still have practical consequences: it may affect your employment in regulated industries, your accommodation, your custody arrangements, and your firearm licence. Before consenting to an IVO, Sam will ensure you understand the full consequences of the conditions.
